General

These terms and conditions govern the relationship between The Ticket Merchant (ABN 25 453 210 068) (“The Ticket Merchant” or “we”) and customers, or potential customers, who use The Ticket Merchant website and/or purchase tickets through The Ticket Merchant website (“you” or “your”).

By accessing The Ticket Merchant website and/or placing an order for tickets through The Ticket Merchant website you agree to be bound by the following terms and conditions. If you do not agree with these terms and conditions, please do not use The Ticket Merchant website.

WE ARE NOT AN OFFICIAL TICKET AGENT OR AUTHORISED SELLER.

The Ticket Merchant is not the official ticket agent or authorised seller for any event. We are a ticketing marketplace that facilitates the secondary sale of tickets.  Given that we are not the official ticketing agency the prices of tickets offered for sale on The Ticket Merchant website may be higher than the original face value of the ticket or the price of tickets being offered by the official ticketing agency.

Ordering

The Ticket Merchant uses both PayPal, Stripe and ZipPay as payment gateways to ensure all transactions placed through The Ticket Merchant website are as secure as possible. Orders placed are subject to credit/debit card approval and customer account verification.

Delivery

Wherever possible The Ticket Merchant seeks to use and provide E-tickets or Mobile tickets to ensure easier and quicker delivery of tickets to you. By placing an order for a ticket through The Ticket Merchant website you agree that you are willing to accept delivery of an E-ticket or mobile ticket by email. An E-ticket or mobile ticket will generally be emailed to you no later than 7 days before the scheduled date of the event. If you have not received your tickets by then, please check the junk folder of your email account.

Where E-ticket/mobile tickets are not available, The Ticket Merchant will send your tickets by registered post (free of charge). If the scheduled event is within 5 Business Days of the date on which you place your order, your tickets will be sent by express post (free of charge). To allow you to track the progress of your hard copy tickets once posted, the tracking number for your tickets will be emailed to you. Wherever possible, hard copy tickets will generally be posted so as to be delivered to you no later than 7 days before the event. If you have not received your tickets by then, please contact The Ticket Merchant.


Refunds

A full refund of the price of your ticket (minus any additional fees and charges levied at the time of purchase) will be provided in the following circumstances:

» if your event is cancelled and NOT rescheduled; or
» where there is a significant relocation of the event that makes it impossible for you to attend the event and where the nature and experience of the event is fundamentally altered by that relocation.

You will not be entitled to a refund where:

» you change your mind;
» you are no longer able to attend the event;
» the event is rescheduled;
» the event is only partially performed;
» you do not enjoy the event;
» a support act for an event is altered;
» there is a subsequent release of additional tickets for the same event;
» an understudy is used in the event rather than the headline performer; or
» your tickets are lost or stolen.

In order to obtain a refund for a significantly relocated event you must contact The Ticket Merchant (dependent on the timing of the re-scheduling or relocation) not less than [5] Business Days before the scheduled date of the event. Where the relocation occurs less than [5] Business Days prior to the original event date you must contact The Ticket Merchant within [1] Business Day of the rescheduling or relocation being advised.

Coupons

» Only one coupon code may be used per order.
» Each coupon code may only be used once
» Coupon codes are not valid in conjunction with any other offer.
» The Ticket Merchant reserves the right to retract any promotion at any time without explanation
» The Ticket Merchant reserves the right to cancel any order in which it thinks coupons have been misused – in this case the buyer will be provided with a full refund.
» In the instance of an event cancellation, customers will be given a full refund via the original method of payment.
» Returns or purchase cancellations are not accepted.


100% Guarantee

The Ticket Merchant guarantees that:

» Your ticket will be as described on the website;
» You will get the tickets you purchased in time for the event;
» Your ticket will gain you entry into the event;

or (in the very unusual circumstances that your ticket is not received or does not give you access to the event) you will receive a full refund of the price you paid for the ticket.

Unless this limitation of liability is otherwise precluded by law, The Ticket Merchant advises that the 100% guarantee will only cover price of the ticket purchased (plus any additional fees and charges levied at the time of purchase) and does not extend to any other incidental or otherwise unforeseeable costs that you may incur in addition to the price of the ticket, for example the cost or flights or accommodation in circumstances where you have chosen to purchase tickets to an event that is being held in a location other than where you generally reside.

The 100% Guarantee DOES NOT apply if actions by you or a related party has caused the cancellation of the ticket/s or rejection from the venue by doing such things such as informing venue or primary ticket staff/personal that the tickets were purchased from The Ticket Merchant.


Limitation of liability

The Ticket Merchant notes that the terms and conditions governing some tickets (as imposed by the ticketing agent or authorised seller) seek to limit the original ticket holder’s right to on-sell that ticket on secondary markets or transfer that ticket to another person.  In addition, some laws in Australia make it an offence to purchase a ticket that has been on-sold on a secondary market or otherwise transferred from the original ticket holder in certain circumstances.

Other than as set out in our 100% Guarantee or as otherwise required by law, The Ticket Merchant makes no representations, gives no warranties and does not accept responsibility or liability for any Liability or Loss you may suffer as a result of purchasing a ticket through The Ticket Merchant website whether such Liability or Loss arises in contract, tort (including negligence), under a statute (including fines or penalties) or otherwise.


Definitions

“Business Day” means a day that is not a Saturday or Sunday, bank or public holiday in Victoria.

“Liability” means all liabilities (whether actual, prospective or contingent), losses, damages, costs and expenses of any description.

“Loss” means any loss, damage, Liability, cost, diminution in value or deficiency of any kind or character that a party pays, suffers, incurs or is liable for.

 

Governing law

AUS Site:
These terms and conditions are governed by and construed in accordance with the laws of the State of Victoria and the parties submit to the non-exclusive jurisdiction of the courts of Victoria.

NZ Site:
These terms and conditions are governed by and construed in accordance with the laws of New Zealand and the parties submit to the non-exclusive jurisdiction of the courts of New Zealand

UK Site:
These terms and conditions are governed by and construed in accordance with the laws of the The United Kingdom and the parties submit to the non-exclusive jurisdiction of the courts of The United Kingdom.
